General Terms and Conditions (GTC)

§ 1 Scope of Application

(1) These GTC govern the legal relationship between the operator of the website ("Mediator") and the registered users ("Users", "Sellers", "Interested Parties") regarding the use of the platform, memberships (Bronze, Silver, Gold), and the mediation of exchange and purchase transactions relating to pewter casting moulds.

(2) By registering and/or using the platform, the user accepts these GTC.

§ 2 Registration and User Account

(1) Certain functions (listing offers, mediation services) require registration.

(2) Users must provide truthful information and keep their information up to date. User accounts are non-transferable.

§ 3 Membership Plans

(1) Available membership levels: Bronze, Silver, Gold.

(2) Services and prices are described in the "Membership" section of the website.

(3) Membership fees must be paid in advance.

(4) There is no automatic renewal; cancellation must be made at least 14 days before expiration.

(5) The membership fee compensates the provision of the respective membership and the associated services for the agreed term. Refunds of membership fees already paid due to non-use or early termination by the user are generally excluded.

The statutory rights of users, in particular mandatory consumer rights and any existing right of withdrawal, remain unaffected.

If the Mediator permanently discontinues the service, membership fees already paid may be refunded on a pro rata basis.

§ 4 Subject Matter of the Mediation Service

The Mediator acts solely as an intermediary for establishing contact between sellers and interested parties. The Mediator is not involved in payment processing and provides no payment or financial services. Purchase or exchange agreements are concluded exclusively between the seller and the interested party.

§ 5 Mediation Procedure

1. The interested party contacts the Mediator (e.g. by e-mail or through a contact form).
2. The Mediator establishes contact between the interested party (buyer) and the seller.
3. The purchase agreement is concluded exclusively between the buyer and the seller.
4. Payment is made directly between buyer and seller or through an external payment service provider used by the seller. The Mediator is at no time the recipient or custodian of customer funds.
5. The seller ships the goods after receipt of payment or according to an individual agreement with the buyer.
6. For successful mediation, the seller owes the Mediator a commission of [e.g. 10%] of the sale price. Settlement takes place after the conclusion of the contract or after the successful sale.

§ 6 Mediation Fee

The mediation fee amounts to 5%–10% of the sale price, depending on the selected membership level. The fee is invoiced to the seller after successful mediation.

§ 7 Obligations and Liability

No liability is assumed for the condition, authenticity, or functionality of the goods. The obligation to ship the goods rests with the seller. The Mediator shall only be liable in cases of intent or gross negligence. No warranties or guarantees are provided.

§ 8 Notice Regarding Historical Representations and Unconstitutional Symbols

Our database may contain images of historical original sources and collectible items that display symbols or emblems of unconstitutional organizations. Such content is provided exclusively for documentation, research, academic or historical classification, and reporting purposes. We expressly distance ourselves from any unconstitutional ideology. The presentation of such material does not constitute approval, endorsement, or promotion of such ideologies. Any use of the content for propaganda, glorification, or other unlawful purposes is prohibited. In the event of suspected misuse, we reserve the right to remove content, block access, or terminate contracts without notice.

§ 9 Data Protection

Personal data is processed in accordance with the GDPR and applicable German data protection laws. Data is used only to the extent necessary. Further details are available in the Privacy Policy.

§ 10 Final Provisions

German law shall apply. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded. Should any provision of these GTC be invalid, the remaining provisions shall remain unaffected. The place of jurisdiction, where legally permissible, shall be the registered office of the Mediator.
